Please read these Terms and Conditions carefully before registering to bid or purchasing any lot at an Ivory Legacy auction. By registering or submitting a bid, you agree to be bound by these terms.

1. Definitions

In these Terms and Conditions:

  • "Auctioneer" means IVORY SAS, a société par actions simplifiée registered in France (SIREN 534 826 908), with its registered office at 24/26 quai Alphonse le Gallo, 92100 Boulogne-Billancourt, France.
  • "Buyer" means the person who places the highest accepted bid for a Lot.
  • "Seller" means the person or entity consigning a Lot for sale.
  • "Lot" means any item or group of items offered for sale at auction.
  • "Hammer Price" means the price at which the Auctioneer accepts the highest bid.
  • "Buyer's Premium" means the commission payable by the Buyer to the Auctioneer in addition to the Hammer Price.
  • "Reserve Price" means the minimum price below which a Lot will not be sold, which is confidential between the Auctioneer and the Seller.

2. Registration

To bid at an Ivory Legacy auction you must register in advance. Registration requires:

  • Completion of a registration form including full name, address and contact details.
  • Provision of valid government-issued photographic identification.
  • Proof of address issued within the last three months.
  • Where required by applicable anti-money laundering regulations, provision of additional documentation regarding the source of funds.

We reserve the right to refuse registration at our absolute discretion. Registration does not guarantee the right to bid.

3. Buyer's Premium

The Buyer's Premium is payable by the Buyer in addition to the Hammer Price. The current Buyer's Premium schedule is as follows:

  • 26% on the first €100,000 of the Hammer Price.
  • 20% on the portion between €100,001 and €400,000.
  • 14.5% on any amount above €400,000.

Buyer's Premium is subject to French VAT (TVA) at the applicable rate where required by law. VAT number: FR 32 534826908.

4. Bidding

Bids may be placed:

  • In the saleroom: by raising your paddle.
  • By telephone: with advance arrangements made no less than 24 hours before the sale.
  • Online: through our approved online bidding platform during the live auction.
  • As an absentee bid: by submitting a maximum bid in advance, which the Auctioneer will execute competitively on your behalf.

All bids are made in the currency in which the lot is quoted. By bidding you confirm that you have read the catalogue description of the lot and are satisfied with its condition and provenance.

The Auctioneer's decision on all bidding matters is final. The Auctioneer may refuse a bid, withdraw a lot, re-offer it or resolve any dispute at their sole discretion.

5. Sale and Transfer of Title

When the Auctioneer's hammer falls, a binding contract of sale is formed between the Buyer and the Seller. Title to the lot passes to the Buyer only upon receipt of full payment including Buyer's Premium, applicable taxes and any other charges.

Risk in the lot passes to the Buyer at the fall of the hammer.

6. Payment

Payment of the total amount due must be received within seven (7) calendar days of the sale date. We accept:

  • Bank transfer (preferred method)
  • Major credit and debit cards (subject to a processing fee)
  • Certified or cashier's cheque (subject to clearance)

Ivory Legacy does not accept cash payments above the legal threshold. Payments must be made in the invoiced currency. We reserve the right to charge interest at 1.5% per month on any overdue amounts.

7. Collection and Delivery

Buyers are responsible for collecting their purchases within fourteen (14) days of the sale. Storage charges of €60 per lot per day will apply thereafter. We can arrange worldwide shipping and insurance through our approved logistics partners at the Buyer's cost.

Export licences, import permits and any customs duties are the sole responsibility of the Buyer. We will provide documentation to assist, but give no warranty as to the exportability of any lot.

8. Condition of Lots

All lots are sold as described in the catalogue and in the condition in which they are found. Catalogue descriptions are provided in good faith based on available scholarship and expert opinion. Condition reports are available on request and buyers are encouraged to inspect lots in person during preview viewings.

Ivory Legacy warrants the authenticity of every lot as described in the catalogue for a period of five (5) years from the date of sale. If within that period it is established by unimpeachable evidence that the lot is not authentic, we will rescind the sale and refund the total amount paid, provided the lot is returned to us in the same condition.

9. Provenance and Export

IVORY SAS only offers lots that have clear, documented provenance. All lots are subject to due diligence checks in accordance with applicable cultural property laws, including French law on the circulation of cultural goods (Code du patrimoine), CITES regulations governing trade in fossil ivory, and applicable UNESCO conventions on cultural heritage.

Buyers are responsible for ensuring compliance with all laws applicable to their country of residence or destination. Ivory Legacy makes no representation as to whether a lot may lawfully be imported into any jurisdiction.

10. Withdrawal and Buy-In

The Auctioneer reserves the right to withdraw any lot before or during the sale without liability. If a lot is unsold (bought-in), no contract of sale is formed.

11. Limitation of Liability

To the fullest extent permitted by law, Ivory Legacy's liability to any Buyer shall not exceed the total sum paid by that Buyer for the relevant lot. We shall not be liable for any indirect, consequential or special loss howsoever arising.

12. Governing Law and Jurisdiction

These Terms and Conditions are governed by French law. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the competent courts of Paris (Tribunal de commerce de Paris), unless mandatory consumer protection law provides otherwise.
